
Neutral Investigations
This is where one of our Neutrals meet with all employee(s) and manager(s) involved, either face to face or online, to ascertain the relevant facts and views arising out of one of the following –
- a grievance
- suspected incapability
- alleged misconduct
- previous investigatory, disciplinary or appeal proceedings
- working relationship breakdowns
- trust and confidence issues
Subject to the views of all concerned, an employee may be accompanied at a Neutral Investigation by any companion of his/her choice other than a paid representative PROVIDED that the companion is not also alleged to be involved in the matter being investigated, and does not disrupt the meeting in any way. Also, questions asked of an employee must be answered directly by him/her.
Everything said during the Neutral Investigation Meeting is “on the record”.
The Neutral will take notes of the meeting. A copy of these, or of the typed transcript, will be sent to the employee(s) and/or manager(s) present at that meeting who will have a short period of time to submit any amendments of what he/she believes was actually said. A copy (or amended copy) will also be sent to the employer’s HR Department.
Anyone present may take notes of the Neutral Investigation Meeting. All other forms of recording the discussion are not permitted.
The Neutral will also send a copy of his report to both the employee concerned and to HR.
