Neutral Discussions

This is where one of our Neutrals, meet with the employee(s) and/or manager(s) concerned, either face to face or online, to discuss their views and concerns, and how they may be resolved.

A Neutral Discussion is usually held in an atmosphere which is friendly and informal. The objects are to -

  • ascertain and understand their views and concerns
  • appreciate what they prefer by way of outcome
  • obtain their consent to the most preferred process

In order for these discussions to be perceived as “safe” by all concerned, and because they are exploratory, they are held on a “without prejudice” basis, meaning that nobody may refer to them in any subsequent legal or other proceedings.

Anything said expressly in confidence to our Neutral will be respected as such, and subject to the following, will not be disclosed without the author’s prior permission. However, our Neutral will feel obliged to disclose anything said to protect someone’s mental and/or physical safety or where there is, or may be, a legal duty to make such disclosure. If in doubt, either our Neutral or the employee concerned should raise this during the Neutral Discussion.

Subject to the views of all concerned, all people taking part in a Neutral Discussion may be accompanied if they wish by any companion of their choice other than a paid representative.

Anyone present may take notes of the Neutral Discussion but these must be compatible with the “without prejudice” nature of the meeting. All other forms of recording the discussion are not permitted.
