We help the employer and employee to agree settlement terms to enable both of them to move on with pride and dignity intact.
During that awful meeting when so often the employee concerned first hears the bad news, that neutral works with the employee & his/her solicitor, and with HR as a "go-between". This is appreciated as a more kind and compassionate approach rather than (with respect to the lawyers) leaving the two legal representatives to "fight it out", particularly at such a a stressful time.
Our neutral will listen to the issues, including the hurt and disappointment, and seek to address these as well as the inevitable monetary considerations in an atmosphere free of threats and other negativity.
Our role is not to replace that of the solicitors in connection with compromise agreements, but rather to confine that role to the offering of professional advice to their respective clients in respect of terms which are mediated by our neutral. His job is to bring everyone concerned quickly and kindly to reaching agreed equitable terms.
He has no interest in adversarial dramatics, only in enhancing negotiations in a way which causes everyone the least amount of discomfort and hurt.
The employer's HR representative and the employee (and his/her solicitor) liaise with each other solely through our designated neutral. This will help to take enhance mutual understanding of the respective positions in a safe and respectful environment without the more usual trappings of anger, upset and other factors which can sometimes work against achieving an early agreement.
Provided that the matter can proceed without delay, closure normally takes two weeks, but can be achieved within two days if required.
And - we will all have avoided grievance hearings, grievance appeal hearings, employment tribunal proceedings, and a whole range of other activities which, when it really comes to it, help nobody at a time when they could well do without further aggravation and time/costs which can be saved.
